Abstract/Resumen
How does the tutelage affect the sovereignty of the Brazil’s aboriginal people ?
This article proposes a discussion about the aboriginal sovereignty. Thus, we will mention some Latin-American investigators, whose works study the rights of aboriginal people, their circumstances, and determinants. From these papers, we will propose to reflect about the occidental state law, characterized by the juridical monism, which was first mentioned by Hans Kelsen. We will discuss the analysis of the state law, and the possibilities of both the creation of a multicultural estate and the imposition of a juridical pluralism. We will develop our arguments by saying that any society has a particular form of law, which implies, in the social and cultural aspect, an affirmation. Finally, we will study the work of Antonio Carlos Souza Lima to discuss the effects of the tutelage of the aboriginal people of Brazil.

Résumé
La souveraineté autochtone existe-t-elle? Dans cet article, j’aborde cette question à travers une lecture critique des ouvrages de quelques chercheurs d’Amérique Latine, qui examinent les droits spécifiques des peuples autochtones, leurs conditions et leurs déterminants. À partir de ces lectures, je propose d’une part une réflexion sur le droit étatique occidental, caractérisé par le monisme juridique, d’abord défendu par Hans Kelsen. D’autre part, je discute des possibilités de la création d’un État multiculturel et de l’imposition d’un pluralisme juridique. Je développe mon argument en affirmant que toutes les sociétés ont des formes spécifiques de droit, mais que cela implique plutôt une affirmation sur le plan de l’identité sociale et culturelle. Pour finaliser mon argument, je me base sur l’ouvrage d’Antônio Carlos de Souza Lima pour discuter des effets du pourvoir tutélaire sur les peuples autochtones du Brésil.
